ด้วยนโยบายของรัฐบาลที่ส่งเสริมและพัฒนากัญชงเป็นพืชเศรษฐกิจ ด้วยการต่อยอดภูมิปัญญาและความรู้ของปราชญ์ชาวบ้าน ในการสร้างนวัตกรรมผลิตภัณฑ์เกษตรแปรรูปเพื่อเพิ่มมูลค่าผลผลิตทางเกษตร ซึ่งจะเป็นการสร้างโอกาสทางเศรษฐกิจและสร้างรายได้ของประชาชน โดยกำหนดกลไกการดำเนินงานที่รัดกุมตามที่กฎหมายบัญญัติไว้อย่างเคร่งครัด เพื่อมิให้เกิดผลกระทบทางสังคม จึงนำไปสู่การปรับสถานะให้ส่วนต่างๆ ของพืชกัญชาและกัญชงเฉพาะที่ได้รับอนุญาตให้ผลิตภายในประเทศไม่จัดเป็นยาเสพติดให้โทษในประเภท 5  ซึ่งประกอบด้วย เปลือก ลำต้น เส้นใย กิ่งก้าน ราก ใบซึ่งไม่มียอดหรือช่อดอกติดมาด้วย เมล็ดกัญชง น้ำมันจากเมล็ดกัญชง สารสกัดจากเมล็ดกัญชง สารสกัดจากกัญชาหรือกัญชงที่มีสารแคนนาบิไดออล (Cannabidiol; CBD) เป็นส่วนประกอบ รวมถึงกากที่เหลือจากการสกัดเฉพาะที่มีสารเตตราไฮโดรแคนนาบินอล (THC) ไม่เกินร้อยละ 0.2 โดยน้ำหนัก ดังนั้น กัญชา กัญชง และสารสกัดเฉพาะส่วนที่ไม่จัดเป็นยาเสพติดให้โทษในประเภท 5 ดังกล่าว จึงสามารถนำมาใช้ในผลิตภัณฑ์สุขภาพได้ภายใต้กฎหมายเฉพาะสำหรับผลิตภัณฑ์นั้นๆ ทั้งนี้ สำหรับอุตสาหกรรมอาหาร การนำส่วนของกัญชาหรือกัญชงมาใช้เป็นส่วนประกอบในอาหารที่ผลิตเพื่อจำหน่าย ต้องใช้ตามวัตถุประสงค์ทางอาหารเท่านั้น โดยเป็นไปตามเงื่อนไขของประกาศกระทรวงสาธารณสุข (ฉบับที่ 424) พ.ศ.2564 ออกตามความในพระราชบัญญัติอาหาร พ.ศ. 2522 เรื่อง กำหนดอาหารที่ห้ามผลิต นำเข้า หรือจำหน่าย และมีการควบคุมคุณภาพและความปลอดภัยอาหารภายใต้กฎหมายอาหารตามหลักการการวิเคราะห์ความเสี่ยง

 

เพื่อเป็นการคุ้มครองความปลอดภัยผู้บริโภค และเป็นแนวทางการพัฒนาผลิตภัณฑ์อาหารที่มีสารสกัดแคนนาบิไดออลเป็นส่วนประกอบ ให้มีคุณภาพที่เหมาะสมและไม่ก่อให้เกิดความเสี่ยงจากการบริโภคเป็นอาหาร จึงมีความจำเป็นต้องกำหนดมาตรฐานผลิตภัณฑ์อาหารที่มีสารสกัดแคนนาบิไดออลเป็นส่วนประกอบ กระทรวงสาธารณสุข จึงได้ออกประกาศกระทรวงสาธารณสุข (ฉบับที่ 429) พ.ศ. 2564 ออกตามความในพระราชบัญญัติอาหาร พ.ศ. 2522 เรื่อง ผลิตภัณฑ์อาหารที่มีสารสกัดแคนนาบิไดออลเป็นส่วนประกอบ  ซึ่งมีสาระสำคัญโดยสรุป ดังนี้...

According to the policy of the Thai Government on promotion of hemp plant to be a new cash crop, development of innovative and value-added processed products of agricultural origin based on the Thai local wisdom and indigenous knowledges has been employed to create a business opportunity for local people with the aim of improving their income. This policy has been being brought forward to implement through appropriate interventions including the regulatory measures in order to avoid negative social impacts. Therefore, only certain parts of cannabis or hemp that are legally produced in Thailand have been removed from the Schedule V of narcotic substances . These include bark, stems, fiber, branches, roots and leaves without sugar leaves or flowering tops of hemp or cannabis, hemp seeds, edible oil derived from hemp seeds, extracts derived from hemp seeds, and extracts derived from hemp or cannabis including extraction-residues that contain CBD and less than 0.2% of THC by weight. The legalized parts of hemp or cannabis, therefore, can be processed to make several health products under control of relevant laws and regulations. Regarding food industry, using parts of cannabis or hemp in food produced for commercial purposes is only allowed under the general purpose of food and its qualities and safety are controlled under the Food Law based on the risk analysis principle.

 

In order to ensure consumer safety and to establish the appropriate measures and requirements to control quality and standard of food products containing cannabidiol extract that could possibly pose risk to consumers from health-harming chemical intakes. The Ministry of Public Health, by virtue of the Food Act B.E.2522 (1979), issued the Notification of the Ministry of Public Health (No.429) B.E.2564 (2021) Re: Food Products Containing Cannabidiol Extract.
